These Terms & Conditions ("Terms") govern your use of the website operated by Food Operate Company ("Food Operate", "we", "us"), registered at Business Centre, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates, and of the Food Operate Power Data business portal (together, the "Services"). By using the Services you accept these Terms. If you do not agree, please do not use the Services.
1. Who may use the Services
The Services are intended for businesses and professionals in the food and beverage industry. By using them you confirm that you are at least 18 years old and, where you act for a company, that you are authorised to bind that company.
2. Listings
- Offers, demands, promotions and product information ("Listings") are provided by businesses or compiled by us from business sources.
- Listings are published for information only. They are not an offer by Food Operate to buy or sell, and every transaction remains subject to confirmation between the parties.
- Prices, quantities, specifications and availability are indicative and may change without notice. We try to keep Listings accurate but do not guarantee that they are complete, current or error-free.
3. Our role
Food Operate connects buyers and sellers. Unless we expressly agree otherwise in writing, we are not a party to any contract between users and we do not guarantee the quality, safety, legality, quantity, delivery or payment of any goods. Each party is responsible for its own due diligence and for complying with all applicable laws, including food-safety, labelling, halal, import/export and customs requirements.
4. Business accounts
Access to the business portal is granted by us. You must keep your login details confidential and you are responsible for all activity under your account. Listings shown to you only because you are a registered or selected business are confidential and must not be shared with third parties. We may suspend or close an account that breaches these Terms.
5. Acceptable use
You agree not to:
- post or send false, misleading, unlawful or infringing content;
- copy, scrape, resell or systematically extract Listings or data without our written permission;
- interfere with the security or operation of the Services, or attempt to access data you are not authorised to see;
- use the Services or our contact channels to send spam or unsolicited marketing.
6. Communications
When you contact us or submit an enquiry, you agree that we may reply and contact you about your enquiry, the related Listings and our Services by e-mail, phone or WhatsApp. We send marketing messages only where you have agreed to receive them; you can opt out at any time by replying "STOP" on WhatsApp or by contacting us at info@FoodOperate.com.
7. Intellectual property
The website, the platform, its database, design, texts and the Food Operate name and logo belong to Food Operate Company or its licensors. Businesses that submit Listings grant us a non-exclusive licence to publish them through the Services.
8. Liability
To the fullest extent permitted by law, the Services are provided "as is" and Food Operate Company is not liable for any indirect or consequential loss, loss of profit or business, or for losses arising from transactions between users. Nothing in these Terms limits liability that cannot be limited under the applicable law.
9. Indemnity
You agree to indemnify Food Operate Company against claims arising from Listings you submit, your transactions with other users, or your breach of these Terms.
10. Changes and termination
We may update these Terms or change or discontinue any part of the Services. The current version is always published on this page with its date. Continued use after an update means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, and the courts of the Emirate of Sharjah have exclusive jurisdiction over any dispute.
